The innovation is the basis of a transfer object, which is often at a very early stage of development, so that the actual market potential can often not be clearly identified or analysed. Patents can be helpful here as a decisive success factor for the progress of an idea, as they create a protective framework for the further development of innovations, especially in the case of research results that are not yet fully deeloped.
Monitoring of the patent process
If the invention meets all criteria of novelty, inventive step and industrial applicability, this innovation is claimed by the employer after recommendation of the SVH and registered as industrial property right. In this process, the patent procedure is accompanied from the application, through the examination procedure, to the grant or possible abandonment, and the permanent correspondence between the inventors and the patent attorneys is coordinated. Within this process step it is also decided whether the patent should be applied for on a national, regional or international level in order to obtain the broadest possible but appropriate patent protection for the innovation. The management of deadlines and costs is also taken care of, as well as the complex monitoring of annuities. During the individual stages of the procedure, the application is constantly reviewed with regard to the criteria of §1 PatG, so that letters of recommendation are once again sent to the employer, which contain a proposal on the continuation or abandonment of the patent application.
Cost of patenting
It is important to mention here in particular that no costs arise for the scientist during the patent procedure of the service invention, but these are borne by the employer, unless he decides to return the invention freely and to the inventor, so that the latter can pursue the application in his own name and at his own expense.
